Terms of Service

Last updated: October 29, 2026

These Terms are an agreement between 29Safety ("29Safety," "we") and the company or person using the 29Safety service or buying a done-for-you package ("Customer," "you"). You agree to them by checking the box when you sign up, by checking the box when we ask you to agree to an updated version, by checking the box at checkout when you buy a done-for-you package, or by using the service. The person who agrees confirms that they are authorized to accept these Terms for the Customer. We keep a record of who agreed, when, from where, and to which version.

These Terms are written in English and Spanish, and both versions say the same thing. If you ever find a difference between them, email safetyteam@29safety.com and we will correct the version that is wrong. If the English and Spanish versions of these Terms, the Privacy Policy or the Safety Disclaimer differ, the English version controls.

1. What 29Safety is, and what it isn't

1.1 29Safety is software that helps employers create and manage safety documents and records: written programs, job hazard analyses, toolbox talks, training records, incident logs, and related tools, plus Harli, a synthetic intelligence (SI) assistant.

1.2 29Safety is not a substitute for a competent person, a qualified safety professional, an attorney, or your own judgment. Templates, text written by Harli, and hazard libraries are general information. They may not fit your specific site, work, or jurisdiction, and regulations change.

1.3 You are responsible for: reviewing and approving every document before use; having a competent person evaluate site conditions; training your workers; and complying with OSHA, state-plan, and other laws. Using 29Safety does not make you compliant and does not guarantee that you will pass any inspection, audit, or prequalification.

1.4 Harli is a synthetic intelligence (SI) built on a large language model. She is software, not a person, and she can make mistakes. Her answers are not reviewed by a person before you see them. She is designed to cite her sources and to refer compliance judgments to the 29Safety safety team. Always verify requirements against the cited regulation before relying on them.

1.5 In an emergency, call 911. The service is not an emergency-response system.

2. Accounts

2.1 You must be at least 18 and able to bind your company. You're responsible for everyone you give access to, including workers who sign documents through links or QR codes you share.

2.2 Keep passwords, login links, PINs, and account access secure. Tell us right away at safetyteam@29safety.com if you suspect unauthorized access.

3. Plans and payment

3.1 Free trial. A new company can start with a 14-day free trial. A card is required to start it, and nothing is charged that day. Unless you cancel before the trial ends, the card is charged the price of the plan you picked on day 15 (the day the trial ends, counting the day you signed up as day 1), and the subscription then renews as described in 3.2. We email the account owner and admins a reminder 2 days before the trial ends. You can cancel any time before then on the Billing page in Settings, and you won't be charged.

  • One trial per company and per card. If the email address or the card used to sign up already had a free trial, there is no trial: the plan starts, and the card is charged, the day you sign up.
  • What works during the trial. You can use the service on screen. Printing, downloads, exports, crew links (sign-in links, check-in links and QR codes) and emails to workers stay off until the first payment.
  • Paying early. You can end the trial and pay at any time with "Pay now" on the Billing page. Your plan's first billing period starts that day.

3.1a Add-ons (another state, more storage, more Harli questions) are bought inside the app at the prices shown there.

3.1b Time with the 29Safety safety team (remote and working sessions, program reviews, documents written for you, translations and on-site days) is not included in any plan. It is bought separately, at the price shown when you book. A booked session can be moved up to 24 hours before it starts. A session you miss without moving it counts as used. Refunds are at the discretion of the 29Safety safety team. A refund or a card dispute on a booking affects only that booking, not your plan or your account's access. On-site work is subject to a separate written scope covering travel, access, and safety requirements.

3.1d Done-for-you packages. You can buy written safety programs written for you by the 29Safety safety team as a one-time package, at the price shown at checkout. You agree to these Terms by checking the box at checkout.

  • What you get. The package described at checkout, written from the information you give us and cited to the OSHA rule. We deliver the documents by email or in your 29Safety account.
  • When the clock starts. Delivery times are business days (Monday to Friday, not counting U.S. federal holidays). They start the business day after we receive your completed company information. If something is missing or unclear, the clock waits until we have it.
  • Your information. You are responsible for giving us accurate and complete information about your company, your work and your sites. We write from what you give us. We do not visit your sites or verify it.
  • Corrections. For the Two written programs: within 7 days of delivery, you can ask us to fix errors, or anything that doesn't match the information you gave us, at no charge. For the Bid and prequal packet and the Full safety program: corrections are included at no charge until the prequal reviewer (for example ISNetworld or Avetta) accepts the programs, based on the reviewer's written comments, for up to 90 days after delivery. New programs, new sites or other changes in scope are quoted separately.
  • Review before use. You must review and approve every document before using it. Section 1.3 applies to everything we write for you. A package does not make you compliant. It does not guarantee acceptance by any general contractor, owner, prequalification platform, insurer or inspector.
  • Your documents. The documents we deliver are yours to use for your own company, whether or not you keep a 29Safety plan, unless the payment is refunded or reversed.
  • Turning on the extras. A package's 29Safety extras turn on when you open the link in your confirmation email while signed in as an owner or admin of the company they're for. Each package's extras can be turned on for one company, once.
  • The 30 days of 29Safety. The Two written programs and the Bid and prequal packet each include 30 days of 29Safety. If your free trial is running when you turn them on, it becomes 30 days from the day it started. It follows the free-trial rules in 3.1 except for its length: unless you cancel before it ends, the card on file is charged the price of the plan you picked when it ends. If your trial is over, or your company already uses 29Safety, you get 30 days of the Crew plan as account credit instead.
  • The Full safety program. It includes everything in the Bid and prequal packet and one year of 29Safety on the Crew plan, given as account credit equal to the Crew plan's yearly price. The credit comes off your next bills. With yearly billing it covers a year of the Crew plan, and a bigger plan costs only the difference for that year. With monthly billing it comes off each monthly bill until it's used up. Your plan renews at its normal price unless you cancel before the renewal date.
  • The Full safety program's call and on-site day. It includes one free 1-hour remote session, used within 60 days of your order, and half off the price of one 8-hour on-site day, used within one year of your order, each with a one-use code we email you. Travel, lodging and food for the on-site day are not discounted and are paid at cost. If the package's payment is refunded in full or disputed, the codes stop working, the extras can no longer be turned on, and we may remove any credit not yet used.
  • Refunds. No money-back guarantee. Refunds are at the discretion of the 29Safety safety team. If we can't deliver the package you bought, we refund what you paid for it.
  • Sections 8, 9 and 10 (warranties, liability limits, release and indemnity) apply to every package and everything we write for you.

3.1c Remote assistance. When an owner or admin grants access, the 29Safety safety team may view your account for up to 24 hours (or until access is revoked) for the purpose you state. Every view and action is logged in your account. We do not change your records without you present unless you ask us to in writing.

3.2 Subscriptions renew automatically each month or year until cancelled. Prices are listed on our website and may change with at least 30 days' notice before your next renewal.

3.3 Payments are processed by Stripe. We don't store your full card number.

3.4 Taxes. Prices exclude applicable sales tax, which we collect where required.

3.5 Cancellation and refunds.

  • Cancellation. Cancel anytime on the Billing page in Settings. Cancellation takes effect at the end of the current billing period, and access ends then (see 3.6). If you cancel during a free trial, nothing is charged, and access ends when the trial ends.
  • No money-back guarantee. Payments are non-refundable, including partial periods, except where the law requires otherwise. If the service is broken or consistently gives wrong results and we can't fix it, we may refund some or all of a payment at our sole discretion.
  • A refund ends all access. When we refund a payment, access ends right away for the account owner and every login in the company, including the documents, photos, records, and programs created with the service, and your license under section 6 to use documents created during the refunded period ends. While a card dispute (chargeback) on a payment is open, access is on hold; if the payment is reversed, it is treated like a refund. Before the account's data is deleted, we email the account owner a copy of the records the company entered itself (for example injury logs, training records, and photos).

3.6 No payment, no access. If a payment fails, a free trial ends without a payment, or your paid time ends without a renewal, the account locks for everyone in the company until a payment goes through: logins, QR codes, sign links, and check-ins all stop. While the account is locked:

  • nothing is deleted;
  • the owner and admins can still pay, and can email themselves a copy of the company's records;
  • we email the owner and every admin when the account locks, and again 7 days before the 90-day mark.

If no payment is made within 90 days, we email the owner and admins a complete copy of the company's records (the download link works for 90 days), and we may then delete the account and its data.

3.7 When your subscription ends. When your subscription ends (it was canceled, a free trial ended without a payment, or a payment wasn't made), your license to use the service ends and the account locks as described in 3.6. Your records are not deleted at that point. For 90 days after the account locks, the owner and admins can still sign in to pay, or to email themselves a complete copy of the company's records. Before the account's data is deleted, we email the owner and admins a complete copy, and its download link works for 90 days. If the account never had a payment (a free trial that ended without one), each copy holds the records the company entered itself, such as injury logs, training records, inspections and photos; the written programs and other documents 29Safety generated during the trial are not included. If a payment was refunded, 3.5 applies instead. Keeping the records the law requires is your responsibility: for example, OSHA requires employers to keep the OSHA 300 Log, the privacy case list, the annual summary (300A) and the 301 forms for 5 years following the end of the calendar year they cover (29 CFR 1904.33), and other OSHA rules set their own retention periods for some training, exposure and medical records.

4. Your data

4.1 You own your data: the records, documents, and information you or your workers enter ("Customer Data").

4.2 You give us permission to host, process, and display Customer Data only as needed to provide and improve the service, including sending it to our service providers (see our Privacy Policy).

4.3 Export. You can export your records at any time while your account is open and paid. During a free trial, exports wait for the first payment (see 3.1). If the account is locked or closed, section 3.5, 3.6 or 3.7 explains how you get a copy. You are responsible for keeping the records OSHA and other laws require you to retain (for example, OSHA injury and illness records for 5 years under 29 CFR 1904.33).

4.4 Aggregated data. We may use de-identified, aggregated data (for example, "most common hazards in roofing JHAs") to improve the service. It will never identify you or your workers.

4.5 You're responsible for having the right to enter worker information, and for giving any notices your workers are entitled to.

5. Acceptable use

Don't: break the law with the service; upload malware; try to access other customers' data; reverse-engineer or resell the service; overload it (including automated scraping); or use it to create false safety records.

6. Our content

Templates, hazard libraries, talks, software, and branding belong to 29Safety. While subscribed you may use, edit, and print them for your own company's operations. During a free trial you may use them on screen only (see 3.1). Documents you create from them are yours to keep and use internally after you cancel, unless the payment for the period they were created in was refunded or reversed (see 3.5). You may not resell or redistribute our templates as a product.

7. Availability and changes

We aim for high availability but don't guarantee the service will be uninterrupted or error-free. We may improve or change features. We will give reasonable notice before removing a major feature you're paying for.

8. Disclaimer of warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, 29Safety DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE OR ITS CONTENT WILL RESULT IN REGULATORY COMPLIANCE OR PREVENT INJURY.

9. Limitation of liability

9.1 TO THE FULLEST EXTENT PERMITTED BY LAW, 29Safety WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, OR FOR FINES, PENALTIES, OR CITATIONS ISSUED TO YOU.

9.2 29Safety's TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

9.3 Some jurisdictions don't allow certain limitations; in those places these limits apply to the extent allowed.

10. Release, hold harmless, and indemnity

10.1 RELEASE. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU RELEASE 29Safety AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS FROM ALL CLAIMS FOR INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, FINES, PENALTIES, OR CITATIONS ARISING OUT OF OR RELATING TO YOUR WORKPLACE, YOUR WORK, OR YOUR USE OF THE SERVICE OR OF ANY DOCUMENT, TEMPLATE, OR ANSWER FROM IT, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY 29Safety's OWN NEGLIGENCE.

10.2 DEFENSE, INDEMNITY, AND HOLD HARMLESS. YOU WILL DEFEND, INDEMNIFY, AND HOLD HARMLESS 29Safety AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS FROM AND AGAINST ALL CLAIMS, DEMANDS, LAWSUITS, LOSSES, DAMAGES, FINES, PENALTIES, COSTS, AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES) BROUGHT BY ANYONE, INCLUDING YOUR EMPLOYEES, WORKERS, SUBCONTRACTORS, VISITORS, THEIR FAMILIES AND INSURERS, AND GOVERNMENT AGENCIES, THAT ARISE OUT OF OR RELATE TO: (A) YOUR WORKPLACE OR WORKSITES; (B) ANY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE CONNECTED TO YOUR WORK; (C) YOUR USE OF THE SERVICE OR OF ANY DOCUMENT, TEMPLATE, OR ANSWER FROM IT; (D) ANY CITATION, PENALTY, OR PROCEEDING AGAINST YOU; OR (E) YOUR BREACH OF THESE TERMS. THIS OBLIGATION APPLIES EVEN IF THE CLAIM IS CAUSED, OR IS ALLEGED TO BE CAUSED, IN WHOLE OR IN PART BY THE NEGLIGENCE (WHETHER SOLE, JOINT, CONCURRENT, OR COMPARATIVE), STRICT LIABILITY, OR OTHER FAULT OF 29Safety, EXCEPT TO THE EXTENT A COURT FINALLY DECIDES THAT THE CLAIM WAS CAUSED BY 29Safety's GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.

10.3 We will tell you promptly about any claim covered by 10.2. You will not settle a claim in a way that admits fault for 29Safety or requires 29Safety to do anything without our written consent.

11. Termination

You can stop using the service at any time. We may suspend or end your access for material breach, non-payment (see 3.6), misuse, or a refunded or disputed payment (see 3.5), with notice where practical. Sections 3.1d, 3.5, 3.6, 3.7, 4.3, 6 (last two sentences), and 8 through 12 survive.

12. General

12.1 Governing law and courts: the laws of the State of Texas, without regard to conflict-of-law rules. The state and federal courts in Dallas County, Texas have exclusive jurisdiction.

12.2 Changes to these Terms: we'll post updates and notify account owners by email at least 30 days before material changes take effect. When the Terms change, the owner and admins are asked to agree to the new version the next time they log in.

12.3 Entire agreement; severability; no waiver; assignment. These Terms, with the Privacy Policy and the Safety Disclaimer, are the whole agreement. If a part is unenforceable, the rest stays in effect. Not enforcing a part isn't a waiver. We may assign these Terms to a successor in a merger or sale.
