Minnesota requires a written A Workplace Accident and Injury Reduction (AWAIR) program in listed industries. Start from 29Safety's Safety & Health Program; Harli drafts the AWAIR version as a custom program on any plan, for you to review.

What's in your AWAIR program

Employers in the industries listed in Minn. R. 5208.1500 must have a written AWAIR program that promotes safe and healthful working conditions (Minn. Stat. 182.653, subd. 8). These are the parts the law requires. Harli drafts each one, and the draft is saved in your account for you to review and sign.

Goals and objectives

Clearly stated goals for safe and healthful working conditions, and the objectives for meeting them, so the program is more than a binder.

Subd. 8(a)

Who is responsible

How managers, supervisors and employees are each responsible for carrying out the program, and how management's continued participation is set up, measured and kept going.

Subd. 8(a)(1)

Finding and controlling hazards

The methods you use to identify, analyze and control new or existing hazards, conditions and operations. Hazard analyses for non-routine jobs, and inspection checklists on any phone.

Subd. 8(a)(2)

Telling your people

How the plan reaches every affected employee, so they know the work-related hazards and the controls. A safety talk every week in English and Spanish, signed on a phone or by QR code.

Subd. 8(a)(3)

Investigating accidents

How workplace accidents are investigated and corrective action is carried out. Injuries and near misses get logged in minutes, and a failed inspection item becomes a corrective action with an owner and a due date.

Subd. 8(a)(4)

Enforcing safe work rules

How safe work practices and rules are enforced, written the way you actually run it.

Subd. 8(a)(5)

A review every year

A documented review of the program at least once a year, including how its procedures are being met. The review date is tracked so the program doesn't go stale.

Subd. 8(b)

Walk through a sample JHA or a sample lockout procedure, part by part.

Who needs AWAIR

Minnesota's commissioner of labor and industry lists, by industry code, the employers who must have an AWAIR program (Minn. Stat. 182.653, subd. 9). The list is Minn. R. 5208.1500.

Listed by NAICS code

The list uses six-digit codes from the 2022 North American Industry Classification System. If your code is on it, AWAIR applies to you.

Minn. R. 5208.1500

Industries on the list

Parts of farming, utilities, construction, manufacturing, wholesale and retail, transportation and warehousing, health care, public administration and more. Not every code in a sector is listed, so check yours.

Minn. R. 5208.1500, items A to N

Construction codes

Every heavy and civil engineering construction code (NAICS 237) and every specialty trade contractor code (238) is on the list. Building construction (236) is not on the current list.

Minn. R. 5208.1500, item C

Six months to comply

When an industry code is added to the list, employers in it must comply six months later. The list is updated every five years.

Who needs an AWAIR program in Minnesota?
Employers whose six-digit NAICS code is on the list in Minn. R. 5208.1500 (Minn. Stat. 182.653, subd. 8 and 9). The list reaches across many industries, including the construction trades, many kinds of manufacturing, and trucking and warehousing, so look up your code.
How often does it have to be reviewed?
At least once a year. The review has to be documented, along with how the procedures in the program are being met (Minn. Stat. 182.653, subd. 8(b)).
How does the AWAIR version get built?
You start from 29Safety's Safety & Health Program. Harli drafts the AWAIR version as a custom program on any plan, with each part tied to subdivision 8, and saves it as a draft. You review it, edit anything, and sign it.
Does 29Safety guarantee we pass a Minnesota OSHA inspection?
No, and be careful of any software that says it does. Harli drafts your AWAIR program from the law, with the subdivision cited on every part so you can check it. You review it, and your people run it on the job.
How long does it take?
Your first written program is ready about 10 minutes after you sign up. Read the AWAIR draft through and edit anything you want before you use it.
